The petitioner prays for grant of bail in Khudwan P.S. Case No.47/2013 registered for the offence under Sections 147,148, 149, 427 and 302 of the Indian Penal Code, Section 27 of Arms Act, Sections 3/4/5 of the Explosive Substances Act, Section 17 C.L.Act and Sections 10/20 of the U.A.P. A. Act. The petitioner is also accused in other cases besides one. The present case has been filed under Section 302 of the Indian Penal Code for having Engineered and blasted the vehicle, which was carrying the husband of the informant and six other persons. It is stated that other accused of the present case, who are even named in the F.I.R., have been granted bail. The name of the petitioner transpired in course of investigation through statement of one
Patna High Court Cr.Misc. No.40580 of 2016 (5) dt.18-11-2016 2/2 Vijay Singh, who has also been granted bail.
Record of other bail application have been placed. On perusal, it appears that they remained in custody for more than a year or even more, when they were released on bail The petitioner is in custody since 13..04.2016.
Considering the allegations and other materials available on record in the present case, I am not inclined to grant him bail. The petitioner, however, shall be at liberty to renew his prayer for bail after six months.
