NILU AGRAWAL ORAL ORDER 10-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 06.02.2017 in connection with Warisaliganj P.S. Case No. 14 of 2017 registered for the offence punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code, Section 10 of the Bihar Conduct of Examination Act and Section 66 of the Income Tax Act.

The prosecution case, as lodged by the officer-incharge of Warisaliganj P.S., is that on receiving secret information about gathering of several persons in a rented house at Village Bilari Katrisarai, Nalanda to make arrangement for cheating in

No.26158 of 2017 (3) dt.10-07-2017 2/3 S.S.C., Bihar examination through WhatsApp and mobile, he reached there and apprehended 20 persons named in the First Information Report including the petitioner. On search, Bhushan Kumar and Sunil Kumar were found in possession of mobile sets, Bluetooth, admit cards and certificate of several examinees. It has been submitted by the learned counsel for the petitioner that petitioner has been found to be in possession of two mobiles, ATM card along with some cash. He submits that no objectionable material has been found from the possession of the petitioner and that he has a clean antecedent. It has further been submitted that two of the named FIR named accused along with other accused persons apprehended by the police have since been granted the privilege of bail by a coordinate Bench of this Court in Cr. Misc. No. 24509 of 2017 on 05.07.2017.

However, learned A.P.P. for the State opposes the prayer for bail stating therein that the petitioner is named in the First Information Report.

Considering the facts and circumstances and the materials on record, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction

Patna High Court Cr.Misc. No.26158 of 2017 (3) dt.10-07-2017 3/3 of the learned Additional Chief Judicial Magistrate-II, Nawada in connection with Warisaliganj P.S. Case No. 14 of 2017, subject to the condition that one of the bailors would be a close relative of the petitioner and the petitioner will appear before the learned Court below on each and every date and failure to appear before the learned Court below on two consecutive dates without assigning any reason will entail cancellation of his bail bonds. It is further made clear that the petitioner will cooperate with the investigation and provide necessary details during investigation of other co-accused.
