The petitioner who is in custody since 23.01.2019 has filed the instant application for grant of bail in connection with Budha Colony P.S. Case as No. 233 of 2015 registered for the offence punishable under section 392 of the Indian Penal Code. As per the allegation in the FIR, while the informant was near Sheo Raj Apartment, Boring Canal Road, it is alleged that two persons came on a motorcycle and on the point of revolver took away his purse and mobile.

It is submitted by learned counsel for the petitioner that the FIR was registered against two unknown persons. The name of the petitioner transpired on the confessional statement of co-accused Saurav Kumar. No incriminating articles has

Patna High Court CR. MISC. No.38139 of 2019(4) dt.04-09-2019 2/2 been recovered from the petitioner who is in custody since 23.01.2019. Besides the said confessional statement of the coaccused, there is no other material against this petitioner. The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XVI, Patna in connection with Budha Colony P.S. Case No. 233 of 2015 (G.R. No 6720 of 2015).
