JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 323, 341, 436 and 504 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.
It is alleged that on protest being made for informant constructing wall in the village, the accused persons assaulted the informant when it is specific that Parma Yadav (non-petitioner) set the house of Golki Devi on fire.
Patna High Court Cr.Misc. No.24046 of 2015 (2) dt.13-07-2015 2/2 It is submitted by learned counsel for the petitioners that no injury report is on record and the accusation is omnibus and general. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the fact that accusation against the petitioners is omnibus and general and accusation of setting the house on fire is not against the petitioners, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Jamui in connection with Khaira P.S. Case No. 171 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
