Petitioner is languishing in custody since 29.03.2017 in connection with Sasaram (Model) P.S. Case No. 252/2017 for offences punishable under Section 392 of the Indian Penal Code. The prosecution case, as lodged by the informant, is that he is a salesman of mobile phones and after collecting cash of Rs. 1,47,000/- and having 30 mobile sets of Samsung Company while he was returning, two persons on motorcycle stopped and after throwing red chili powder in his eyes snatched the bag containing cash and mobile phones.

It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.25699 of 2017 (4) dt.14-07-2017 2/2 petitioner that he is innocent, not named in the First Information Report, bears no criminal antecedent and that only one stolen mobile has been recovered from his possession, which he stated that he has bought the same from one Sanjeet Kumar and as soon as he knew that it is a stolen one, deposited the said mobile in the police station. He submits that no T.I. Parade has been done so far and petitioner belongs to a respectable family. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Model) P.S. Case No. 252/2017.
