Petitioner seeks bail in Barachati P.S.Case No.384 of 2018 registered for the offences under Sections 30(a), 38, 47 of Bihar Excise Prohibition Act.

Allegation against the petitioner is of recovery of 120 liters of country made Mahua liquor from the dickey of the vehicle and the petitioner was arrested.

Submission of the learned counsel for the petitioner is that nothing has been recovered from his conscious possession. Moreover, charge sheet has been submitted and he is in custody since 11.06.2018 and he is ready to abide by the conditions imposed upon him.

Heard learned A.P.P. also.

No.47411 of 2018 (4) dt.20-09-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Gaya, in Barachatti P.S. Case No.384 of 2018 subject to the conditions that the petitioner will not induce any witness or tamper with the evidence and the petitioner shall cooperate in disposal of the trial and make himself available as and when required by the court, otherwise, his bail bond shall be cancelled.
