Petitioner seeks bail in Phulwaria P.S. Case No. 66 of 2016 for the offences punishable under Sections 47A and 47G of the Bihar Excise (Amendment) Act.

It has been submitted on behalf of the petitioner that the petitioner has been maliciously dragged in this case with false accusation. The petitioner is not named in the FIR and he was arrested merely on suspicion.

Moreover, nothing incriminating has been recovered from the possession of the petitioner and he is in custody since 12.04.2017. A statement has been made in paragraph no.3 that the petitioner has no criminal antecedent.

Learned APP for the State opposes the prayer for

Considering the above facts and circumstances, this petition for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Gopalganj, in connection with Phulwaria P.S. Case No. 66 of 2016.
