JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,406,467,468,471,323 and 504 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
It is alleged that the informant as persuaded by co accused Devendra Prasad Yadav for getting the amount under Indira Awas scheme sanctioned and consequently he withdrew forty four thousand rupees in two transactions but did not give it to the informant when the informant made protest he was being abused by calling caste name. The petitioner being Halka Karmchari is not named in the FIR. His name transpired during
Patna High Court Cr.Misc. No.33386 of 2015 (2) dt.12-08-2015 2/2 investigation.
It is submitted by the learned counsel for the petitioner that the accusation is specific against co accused Devendra and only on suspicion during investigation the petitioner has been roped in the present case. It is further submitted that co accused Devendra Prasad yadav has been granted anticipatory bail vide order dated 24.6.2014 passed in Cr. Misc. No. 17978 of 2014 and the same has been brought on record as Annexure 2. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Runnisaidpur P.S. Case No.157 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
