The petitioner seeks bail in a case registered under Sections 366, 366A of the Indian Penal Code and Sections-3, 4, 5 & 6 of the Immoral Traffic Prevention Act and Sec 12 of the POCSO Act.
Allegation against the petitioner is of trafficking minor girls.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 24-09-2018. Charge sheet has already been submitted. The alleged occurrence is said to have taken place on 18-09-2018 and the FIR has been instituted on 24-09-2018. Delay in lodging the FIR has not been
Patna High Court CR. MISC. No.42137 of 2019(2) dt.09-07-2019 2/2 explained. The victim girl in her statement recorded under Section-164 Cr.P.C. has not made allegation either of sexual or physical assault by the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge-cum-Special Judge (POCSO) Act, Gaya in connection with Gaya Rail P.S.
