The petitioner seeks bail in connection with Jhajha/ Rail P.S. Case No.53 of 2018 registered under Sections 25(1-B) (a), 26(1) and 35 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that one Md. Kasim was apprehended by the police and, on search, he was found in possession of 5 country made pistol with magzines, who disclosed the name of the petitioner. In fact, the petitioner is accused in four other cases, due to that reason, the police implicated the petitioner in the present case, showing the confessional statement of the co-accused Md. Kasim. The

Patna High Court CR. MISC. No.56805 of 2019(3) dt.04-12-2019 2/2 petitioner is in custody since 08.02.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Lakhisarai, in connection with Sessions Trial No.115 of 2018, arising out of Jhajha/Rail P.S.
