The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 379, 307, 354B, 504/34 of the Indian Penal Code.

As per the F.I.R., the allegation against the petitioner is that he entered in the house of informant and attempted to commit rape with her and on protest, the petitioner assaulted the informant with iron rod, as a result of which, the informant sustained head injury.

It is submitted on behalf of petitioner that informant is none else but own aunt of the petitioner and due to petty dispute between the parties, this false and concocted case has been lodged against this petitioner. Injury has been found to be

Patna High Court CR. MISC. No.51147 of 2021(4) dt.21-07-2022 2/2 simple in nature. It is further submitted that no offence under Section 354(B) of the I.P.C. is made out against this petitioner. Petitioner claims clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as clean antecedent, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IIIrd, Dalsingsarai, Samastipur in connection with Vidyapati Nagar P.S. Case No. 43 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
