2. The petitioner has prayed for bail in connection with Thawe P.S. Case No. 31 of 2025 registered for the offence punishable under Sections 61(2), 103 and 238 of B.N.S.
3. The case of the prosecution, in short, is that the petitioner along with other accused persons have allegedly committed the murder of the daughters of the informant by filling soil forcefully in their mouth.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. She has been falsely implicated in this

It has further been submitted that from perusal of the F.I.R. it will transpire that there is no eye witness of the occurrence and from perusal of the para-52 of the diary it will transpire that when the police has inquired as to who has seen the occurrence for the first time, Chandan Ram disclosed that he has seen the dead body. He has stated that from 10.02.2025 the girls were missing and they were being searched and after the darkness, the family members and he started searching with the help of torch. As they went to the mustard field of one Shailesh Singh, they found a bag. On this Chandan Ram screened and when they went near the bag, the dead bodies of the missing girls were found.
So as per the diary, Chandan Ram has seen the dead bodies for the first time and he has not implicated anybody. It has also been submitted by learned counsel for the petitioner that similarly situated accused persons, namely, Sudama Devi and Malti Devi have already been granted bail by learned Coordinate Bench of this Court vide order dated 08.08.2025 in Cr. Misc. No. 38019 of 2025. The case of this petitioner stands on similar footing. Petitioner is having no criminal antecedent and she is languishing in judicial custody since 12.02.2025.
5. The application for bail is opposed by learned APP for the State and learned counsel for the informant.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.D.J 2nd, Gopalganj in connection with Thawe P.S. Case No. 31 of 2025.
