JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-06-2017 Heard Mr. S.N.P.Sinha, learned Senior Counsel appearing for the petitioner and Mr. Binod Kuamr No.2, learned A.P.P. for the State.

The petitioner is seeking regular bail in connection with G.O. Case No. 05 of 2017 arising out of Town P.S.Case No. 17 of 2017 registered for the offences under Sections 20(b),22,24 of N.D.P.S.Act.

The prosecution case, as disclosed in the FIR, would show that the petitioner was apprehended with one packet of Ganja, containing 24 Puriyas, having total weight of 240 gms. Valued at Rs. 2970/-.

Learned Senior Counsel for the petitioner submits

Patna High Court Cr.Misc. No.25436 of 2017 (2) dt.07-06-2017 2/2 that the seizure list clearly shows that small quantity i.e. 240 gms. of ganja was recovered from the petitioner, which is a baialble offence. The petitioner has clean antecedent and is in custody since 19.02.2017.

Learned A.P.P. having examined the records accepts the position, as submitted by the learned counsel for the petitioner. In the facts and circumstances of the case, as stated above, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Darbhanga, in Town P.S.Case No. 17 of 2017.
