The petitioner apprehends his arrest in connection with Nautan P.S. Case No. 105 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to ulterior motive. There is general and omnibus allegation against the petitioner.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that petitioner is named in the first information report. Petitioner has criminal antecedent. Further he contended that the alleged recovery of illicit liquor has been made from the house of the

Patna High Court CR. MISC. No.51761 of 2021(2) dt.08-04-2022 2/2 petitioner. Hence, this is not a fit case for anticipatory bail. Having considered the facts and circumstances of the case and the submission advanced on behalf of the learned counsel for the State, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected.
