JUSTICE BIRENDRA KUMAR ORAL ORDER 29-06-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 and 120B of the Indian Penal Code.

Accusation against the petitioner is of commission of preparation to commit dacoity.

Submission of the learned counsel for the petitioner is that co-accused Bhola Sahni, who was arrested at the spot and from whose possession firearm and cartridges were recovered, has already been allowed bail by a Coordinate Bench of this Court in Cr. Misc. No. 9044 of 2016 vide Annexure-2. The petitioner was not arrested at the spot and allegation against the petitioner stands on better footing.

Patna High Court Cr.Misc. No.25012 of 2017 (3) dt.29-06-2017 2/2 Learned counsel for the State opposed the prayer for bail on the ground that the petitioner has got similar type of criminal antecedent.

Considering the fact that allegation against the petitioner is on better footing to that of co-accused Bhola Sahni, hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Samastipur/successor Court in connection with S.T. No. 96 of 2017 arising out of Khanpur Police Station Case No. 63 of 2015, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
