JUSTICE SANJAY PRIYA ORAL ORDER 27-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Paroo P.S. Case No. 116 of 1992 instituted for the offence under Sections 395 and 397 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is in custody since 26.02.2018. He is not named in the written report. There is general and omnibus allegation against the petitioner. Counsel for the petitioner further submits that petitioner does not live in the village. He is living outside the village to earn livelihood. Petitioner has been implicated in the instant case on account of land dispute between the parties. Counsel for the petitioner further submits that petitioner is named in the written report as he is son-in-law of Sukhdeo Sahani. There is no
Patna High Court Cr.Misc. No.51239 of 2018 (3) dt.27-09-2018 2/2 allegation against the petitioner in the written report. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, West Muzaffarpur, in connection with Paroo P.S. Case No. 116 of 1992, subject to the condition that both the bailors will be the close relatives of the petitioner.
