Petitioners seek bail in Wazirganj P.S.Case No.163 of 2018 registered for the offences under Sections 341, 323, 504, 354(A), 354(B), 354(C), 354(D)/34 of the Arms Act. Allegation against the petitioners is of misbehaving, abusing with the victim girl while she was going to temple along with her cousin brother and all the accused persons are alleged to have assaulted her brother. Some accused persons snatched away her mobile and other things.
Submission of the learned counsel for the petitioners is that no specific allegation has been attributed to the petitioners and they are in custody for about four months.
Patna High Court Cr.Misc. No.46477 of 2018 (3) dt.14-09-2018 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- each with two sureties of the like amount each to the satisfaction of A.C.J.M. 1st, Gaya, in Wazirganj P.S. Case No.163 of 2018 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioners will not induce any witness or tamper with the evidence and the petitioners shall co-operate in the disposal of the trial and make themselves available as and when required by the court, otherwise, their bonds shall be cancelled.
