The petitioner is apprehending his arrest in connection with Parihar P.S. Case No.174 of 2018 registered for the offence under Sections 395 and 397 of the Indian Penal Code. As per allegation in the FIR, a dacoity was committed in the house of the informant and during that course one miscreant fired a bullet on the informant's wife due to which she sustained bullet injury on her waist and later on she succumbed to the injury as well as the accused persons took away ornaments worth Rs.1.75 lakh as well as one mobile. Learned counsel for the petitioner submits that the petitioner has committed no offence and he has falsely been implicated in this case. He further submits that petitioner has

Patna High Court CR. MISC. No.37373 of 2020(4) dt.26-10-2021 2/2 clean antecedent and his name has figured on the basis of confessional statement of co-accused Mahesh Paswan. However, learned APP for the State vehementally opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, in the event of his arrest or surrender before the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM I/C, Sitamarhi in connection with Parihar P.S. Case No.174 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
