2. The petitioner seeks bail in connection with Nawkothi P.S. Case No. 153 of 2023 instituted for the offences under Sections 384, 387, 504, 506/34 of the Indian Penal Code.

3. As per prosecution case, the accusation against the petitioner is of demanding ransom on the gun point from the teachers of the school and also threatening them to face dire consequences.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case at the instance of enemies of the village in collusion with the

Patna High Court CR. MISC. No.41791 of 2025(3) dt.14-07-2025 2/3 police. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged occurrence. Learned counsel for the petitioner further submits that there is no payment of money or valuable security and, as such, no case of extortion is made out against the petitioner. There is not a single independent witness who has come forward to support the prosecution case. The Invesigating Officer, after completion of investigation, has submitted charge-sheet against the petitioner. The petitioner has three criminal antecedents and is languishing in judicial custody since 21.01.2024 without any rhymes or reason.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged is serious in nature. The petitioner has three criminal antecedents.

6. Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court
