JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 467/468/471/420/120B of the Indian Penal Code.

The prosecution case is that the truck loaded with coal were intercepted but the petitioner being the driver of the truck failed to produce the relevant permit/documents. It is submitted by learned counsel for the petitioner that the coal was being carried under the valid document and the owner of the truck namely, Asha Singh has been granted anticipatory bail by a co-ordinate bench of this court vide Criminal Miscellaneous No.18743 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for three

Patna High Court Cr.Misc. No.31925 of 2015 (2) dt.07-08-2015 2/2 months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No.26 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The provisional bail of the petitioner will be confirmed by the learned court below after getting the document verified, whether the petitioner was carrying the coal under valid document or not. If it is found that the coal was being carried under valid document, the provisional bail of the petitioner will be confirmed by the learned court below, otherwise the petitioner will surrender or pray for regular bail.
