The petitioner apprehends his arrest in Gogari (Paura O.P.) P.S. case No. 64 of 2019 registered under Section 307 and other minor Sections of the IPC and u/s 27 of Arms Act. The informant named the petitioner, Sanoj Ram, and Bijo Singh and alleged that they came and made indiscriminate firing while the informant and his family members were inside the house only because the informant did not provide pipe to the accused for irrigation of land.
The learned counsel for the petitioner submits that Bijo Singh has already been granted anticipatory bail vide order dated 27.05.2019 passed by a coordinate bench of this court in Cr. Misc. No. 34374 of 2019 and the case of petitioner stands on same footing.

No.39453 of 2019(2) dt.27-06-2019 2/2 Taking into consideration the facts that, of course, allegation of firing is made against both accused and 7-8 empty cartridges were recovered from the place of occurrence but since similarly situated accused has already been granted anticipatory bail, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Gogari (Paura O.P.) P.S. case No. 64 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
