Learned counsel for the petitioner submits that earlier vide order dated 05.02.2021 in Cr. Misc. No. 36183 of 2020, the bail application of the petitioner was rejected only on the ground that the petitioner had not mentioned the entire antecedents in the bail application. Learned counsel thus submits that the case was not adjudicated on merits.

Learned counsel for the petitioner submits that the petitioner is in custody since 16.06.2020 and has antecedent of five case.

Learned counsel for the petitioner submits that allegation is of looting the informant of Rs. 98,700/- along with his mobile by three accused persons, further the informant also has clearly stated that he can identify the accused persons on seeing them.

No.51081 of 2021(2) dt.24-02-2022 2/2 Learned counsel for the petitioner submits that the name of this petitioner came in the confessional statement of co-accused Chandan Kumar, nothing was recovered from his possession and he came to be implicated based on his antecedents. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner and submits that earlier his bail application was rejected and thus the petitioner now cannot argue on merits.

The Court concurs with the submission of learned A.P.P. for the State but considering the period of custody, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bajpatti P.S. Case No. 31 of 2020 with a condition that one of the bailors shall be the father of the petitioner (Pravin Kumar Singh) and if the petitioner is involved in a case of similar nature, the court below shall forthwith cancel his bail bonds.
