JUSTICE BIRENDRA KUMAR ORAL ORDER 09-08-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201 of the Indian Penal Code.

Initially, U.D. case was lodged on recovery of dead body of the daughter of the informant. Subsequently, a case of murder was registered on the statement of the informant, as the Doctor has found a case of strangulation. The informant did not raise any suspicion against anyone in the FIR. However, during investigation, a witness stated before the police that there was affair between the deceased and the petitioner. Therefore, petitioner might have committed the murder.

Patna High Court Cr.Misc. No.47033 of 2018 (3) dt.09-08-2018 2/2 Submission is that the petitioner has got no criminal antecedent and the aforesaid cannot be a reason for commission of murder of the deceased by the petitioner rather this might be a case of honour killing. Considering the fact that there is no substantial material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ujiarpur Police Station Case No.216 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
