23-12-2016 Heard Sri Rana Sanjay Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody in N.D.P.S. Case No. 02 of 2016, arising out of Samastipur Rail P.S. Case No. 11 of 2016, registered for offence under Section 414 of the Indian Penal Code and Sections 20 & 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that from the petitioner, recovery of some psychotropic drugs has been shown. According to learned counsel for the petitioner, from possession of the petitioner, Esopam Plus tablets was recovered. Besides this, some cookies, biscuits etc. have also been recovered. He submits that petitioner has falsely been implicated.

Patna High Court Cr.Misc. No.50641 of 2016 (2) dt.23-12-2016 2/2 Learned Addl. Public Prosecutor has opposed the prayer for bail. By way of referring to paragraph - 3 of the petition, he submits that petitioner is habitual offender of committing offence relating to administering sedative drugs to passengers and he is accused in number of cases besides the present case.

I do not find any ground to extend the privilege of bail.

The petition stands dismissed.
