JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 01-07-2026 Learned counsel for the petitioners submits that Petitioner No. 2 has already been arrested, accordingly, he seeks permission to withdraw the present anticipatory bail petition with regard to Petitioner No. 2 as it has become infructuous.
2. Permission is accorded.
3. Accordingly, the anticipatory bail petition with regard to Petitioner No. 2 is dismissed as withdrawn.
4. Heard learned counsel for petitioner no. 1 and learned A.P.P. for the State.
5. The petitioner no. 1 apprehends her arrest in connection with Halsi P.S. Case No. 67 of 2026, instituted for the offences punishable under Sections 126(2), 115(2), 118,
Patna High Court CR. MISC. No.41405 of 2026(2) dt.01-07-2026 2/3 109(1), 329(4), 303(2), 74, 3(5) of the B.N.S.
6. As per the prosecution case, on 18.03.2026 at about 8.30 P.M. all the named accused persons including the petitioners armed with weapons entered into the house of informant and assaulted the informant and his family members and committed loot. The accused persons snatched cash of Rs. 90,000/- and a golden chain from the daughter of the informant. On protest, the accused persons assaulted informant and his family members. Petitioner No. 1 assaulted the wife of informant causing injury.
7. Learned counsel for petitioner no. 1 submits that she is innocent and has falsely been implicated in this case. Both parties are co-villagers and due to some petty matter free fight took place between them in which both the parties have sustained injuries. There is case and counter case between the parties. Petitioner No. 1 is a Pardanashin lady having no criminal antecedent. Allegation against petitioner no. 1 does not corroborate with the injury report of the injured. Petitioner undertakes to co-operate in the investigation and trial.
8. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
9. Considering the facts and circumstances of the

No.41405 of 2026(2) dt.01-07-2026 3/3 case, submission of learned counsel for the parties and clean antecedent of petitioner no. 1, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner no. 1 be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Lakhisarai in connection with Halsi P.S.
