JUSTICE SUDHIR SINGH ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 420 and 379/34 of the Indian Penal Code. Allegation against petitioner is that he along with another co-accused withdrew Rs. 15,000/- with the A.T.M. card of informant but gave only Rs.5,000/- to him. On protest being made, they started mar-pit with informant and when police reached, petitioner was apprehended.

Earlier prayer for bail of petitioner was rejected vide Annexure-1 to the present application with observation "at this stage". This is the second attempt for bail on behalf of petitioner. A report was called for from the trial court regarding stage of the case. It has been reported that charge has already been framed and the trial is expected to be concluded within a period of three months.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage, same is rejected.
