JUSTICE BIRENDRA KUMAR ORAL ORDER 29-05-2017 This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against refusal of the prayer for bail by the impugned order dated 01.04.2017 passed by the learned 2nd Additional Sessions Judge-cum-Special Judge, Bhagalpur in connection with Gopalpur Police Station Case No. 485 of 2014 registered for offences under Sections 363, 365 as well as under Section 3(xi)(xii) of the SCST Act.

The appellant is suspected to have kidnapped the minor daughter of the informant.

The victim-girl, in her statement under Section 164 Cr.P.C., stated that she was kidnapped by the appellant. However, no one misbehaved with her.

Patna High Court CR. APP (SJ) No.1616 of 2017 (2) dt.29-05-2017 2/2 Submission is that the matter is of love-affairs. Considering the facts of this case, let the appellant, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judgecum-Special Judge, Bhagalpur/successor Court in connection with G.R. No. 1655A of 2014 arising out of Gopalpur Police Station Case No. 485 of 2014.

Accordingly, this appeal stands allowed.
