JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-10-2018 The petitioner is in custody since 24.02.2018 in connection with Roushanganj P.S. Case No. 24 of 2018, registered for offences punishable under Sections 120(B), 399, 402 of the Indian Penal Code, Sections 25 (1-B)a/26/35 of the Arms Act, Section 30(a) of Bihar Prohibition of Excise Act 2016 and Section 17 of C.L.A. Act.

Allegation against the petitioner is of recovery of 12 live cartridges and 30 liters country made liquor from him and when the police raided a place from the information as that some persons assembled for committing dacoity.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and there is nothing against the petitioner and he is in custody since 24.02.2018 and though he is an accused in one more case but in that case, he is on bail and is ready to abide by any condition

Patna High Court Cr.Misc. No.46613 of 2018 (5) dt.01-10-2018 2/2 imposed on him for grant of bail.

Heard learned A.P.P. also.

Having heard both sides and considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Roushanganj P.S. Case No. 24 of 2018, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
