2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 498A of the Indian Penal Code and Sections 3 an 4 of the Dowry Prohibition Act.
3. Allegation against the petitioner is of matrimonial cruelty and of demand of dowry.
4. It is submitted by learned counsel appearing on behalf of the petitioner that the entire prosecution case is false and concocted. As a matter of fact, the informant herself does not want to live with this petitioner and she has herself left the house. It is further submitted that prior to lodging of present case, the informant has filed one complaint case with same and
Patna High Court CR. MISC. No.45043 of 2024(3) dt.06-08-2024 2/2 similar allegations, in which petitioner is already on bail. It is further submitted that petitioner is ready to keep the informant, as his wife, with full honour and dignity.
5. Learned A.P.P. for the State has opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the aforesaid facts and circumstances, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran, in connection with Muffasil P.S. Case No. 528 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
