The petitioner seeks bail in a case registered under Sections 379, 411/34 of the Indian Penal Code. The prosecution case, in short, is that the stolen buffalo of the informant was recovered from the pick up van. It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.4.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is alleged to be the driver of the vehicle, on which the stolen buffalo was being kept. The petitioner had no knowledge that the buffalo in question is stolen one. He has been made accused due to mistake of fact.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Kumud Ranjan, J.M. 1st class, Araria in connection with Bhargama P.S. case No.80 of 2019.
