The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 384, 504, 506 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner has antecedent of three cases and the informant alleges that petitioner broke the boundary of his land and committed theft of the gate and even closed the way and threatened the informant when he went to inquire. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is next submitted that from tenor of the allegation as alleged in the F.I.R., it would manifest that there is a dispute relating to land

Patna High Court CR. MISC. No.41071 of 2022(2) dt.12-12-2022 2/2 between the parties on account of which, the present false case came to be instituted.

Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Nathnagar (Lalmatia) P. S. Case No.109 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C. with a condition that one of the bailors of the petitioner shall be his father namely, Md. Jamal. The application stands allowed.
