The petitioner apprehends his arrest in Rajgir P.S. Case No. 185 of 2021, registered for the offences punishable under Section 379, 411 of the Indian Penal Code and section 7 of the Essential Commodities Act.

Prosecution case in brief is that 33 bags of rice were seized from Tata Magic vehicle of which this petitioner is owner. It is suspected that petitioner is involved in blackmarketing of the rice. It is submitted that petitioner has been falsely implicated in this case. Petitioner is not a PDS shop dealer and is not involved in any manner in selling of the rice. Therefore,

Patna High Court CR. MISC. No.55789 of 2021(3) dt.28-06-2022 2/2 no offence under Section 379/411 of the IPC or section 7 of the EC Act is made out against petitioner. In fact, rice belongs to the petitioner and he was going to sell in the market. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Biharsharif, Nalanda in connection with Rajgir P.S. Case No. 185 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
