Petitioner seeks bail in N.D.P.S. P.S.Case No.3 of 2018arising out of Dhangain P.S.Case No.18 of 2018 registered for the offences under Sections 8/20(b)(ii)(B) of N.D.P.S.Act of the I.P.C.

Allegation is of recovery of 21.6 kgs. Ganja from the dickey of the bus and the petitioner was made accused in the F.I.R. It has been submitted on behalf of the petitioner that the said ganja has not been recovered from his conscious possession and at the instance of the conductor he has been made accused in this case and one more case is pending against him. Heard learned A.P.P.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.47483 of 2018 (3) dt.20-09-2018 2/2 circumstances of the case, stated above, I am not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner is rejected.

However, the learned trial court is directed to expedite the trial and conclude it within a period of nine months, and if the trial is not concluded within the stipulate period, the petitioner shall be released on bail to his own satisfaction. This application is disposed of.
