2. The petitioner has prayed for bail in connection with Ramgadhwa P.S. Case No. 194 of 2025 registered for the offence punishable under Sections 191(2), 191(3), 115(2), 126(2), 117(2), 103(1) and 352 of the B.N.S., 2023.
3. The case of the prosecution, in short, is that the petitioner, along with others, has assaulted the son of the informant, who is specially abled.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He further submits that the FIR is in two parts; in the first
Patna High Court CR. MISC. No.39490 of 2026(2) dt.22-06-2026 2/3 part, there is specific allegation against one Sanjeet Yadav, who has beaten badly the son of the informant. In the second part of the FIR, it is alleged that all the accused persons have assaulted the son of the informant who succumbed to the injuries. He further submits that the nature of the allegation is general and omnibus and from perusal of the post-mortem report of the deceased, it will transpire that the doctor conducting the autopsy of the deceased has found the following:
(i) Deformity on the right thigh, with cutting blood and blood clot present with fracture of the right femur at midpart (ii) Bruise on the back of the chest measuring 5"x3", and the doctor conducting the autopsy of the deceased has opined that the cause of death is hemorrhage and shock.

Learned counsel for the petitioner submits that Sanjeet Yadav, who was having a specific allegation of assaulting the deceased, has been granted bail by the learned coordinate Bench of this Court vide Cr. Misc. No. 22256 of 2026. The case of this petitioner stands on better footing. Moreover, a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 15.12.2025.

6. The application for bail is opposed by learned APP for the State.
7. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Motihari at East Champaran in connection with Ramgadhwa P.S. Case No. 194 of 2025.
