JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-11-2023 The present petition has been filed for restoration of a writ petition bearing CWJC No. 7976 of 2018, which has stood dismissed on account of non-prosecution, by an order dated 01.08.2022.

The learned counsel for the petitioners has submitted that on account of the clerk having failed to mark the case in the list, the arguing counsel could not appear on the day

Patna High Court MJC No.1702 of 2023(3) dt.03-11-2023 2/2 the case was taken up for hearing, thus, a sympathetic view be taken and the aforesaid writ petition petition be restored to its original file.

Having regard to the submission made by the learned counsel for the petitioners as also considering the averments made in the present petition, I deem it fit and proper to restore the aforesaid writ petition bearing CWJC No. 7976 of 2018 to its original file.
