1. Heard learned counsel for the petitioner and learned A.P.P., Mr. Chandra Bhushan Prasad for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 110, 117(2), 353, 351(2) and 3(5) of the BNS, 2023.

Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that on the date of occurrence while he was returning to his house with his cousin and reached near Golpur when accused persons including the petitioner came by motorcycle and auto and assaulted by means of an iron rod and khanti causing fracture of his hand and injury over his head, leg and stomach.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the
Patna High Court CR. MISC. No.40602 of 2026(2) dt.06-07-2026 2/3 informant, it is further submitted that from perusal of the allegations as alleged in the FIR, it would manifest that allegation of assault is not specific rather is general and omnibus in nature. It is next submitted that the date of occurrence is 22.04.2025 and the FIR came to be instituted on 01.06.2025 which castes an aspersion on the case of the prosecution. It is also submitted that similarly situated co-accused Harilal Yadav had approached the Court seeking anticipatory bail by filing Criminal Miscellaneous No. 11212 of 2026 and the same came to be allowed by an order dated 25.02.2026 passed by a learned Coordinate Bench.
5. Learned A.P.P., Mr. Chandra Bhushan Prasad for the State opposes the anticipatory bail application of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kako P.S. Case No. 154 of 2025 subject to the conditions
Patna High Court CR. MISC. No.40602 of 2026(2) dt.06-07-2026 3/3 as laid down under Section 482 (2) of BNSS.
7. The application stands allowed.
