This is an application for bail in connection with Sasaram (M) P.S.Case No. 218 of 2017 registered for the offences punishable under Sections 3/4 of Explosive Substance Act, 4/40 of Mining Act and 33/41, 42 of Indian Forest Act. Allegation as per FIR is that huge quantity of explosive substance has been recovered from the truck and petitioner is owner of the truck.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and he is owner of the truck and he has nothing to do with the seized articles and he is in

Patna High Court Cr.Misc. No.27200 of 2017 (3) dt.02-08-2017 2/2 custody for five months.

Heard learned APP and learned Special P.P., Mines. They have opposed the prayer for bail.

Having heard both sides and in view of recovery of huge quantity of explosive substance, I am not inclined to grant bail to the petitioner.

However, learned trial court is directed to expedite the trial and try to conclude it within six months after obtaining sanction and commitment of the case.

With the above observation, this application is dismissed.
