In this case, the petitioner is seeking regular bail in connection with Salimpur P.S. Case No. 77 of 2019 registered for offence punishable under sections 302, 394/34 of the Indian Penal Code and section 27 of the Arms Act.

The petitioner has criminal history.

Learned counsel for the petitioner submits that similarly situated person, Manish Kumar has been granted bail by this Court in Cr. Misc. No. 20354 of 2020 on 02.07.2020, but it appears that Manish Kumar has been granted bail in view of the pandemic Covid -19, it cannot be said that the same relief should be given to the present petitioner.

Investigating Officer has collected sufficient material

Patna High Court CR. MISC. No.1430 of 2021(3) dt.10-02-2021 2/2 during investigation.

Looking to the fact that the petitioner has criminal history and during investigation sufficient material has come against him, this Court is not inclined to grant bail to the petitioner for the present and accordingly his prayer for bail is rejected. However, this Court directs the court below to conclude the trial within a period of nine months from the date receipt/production of a copy of this order, subject to condition that the petitioner would cooperate in disposal of the case.
