JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-08-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 447, 448, 308 and 504/34 of the Indian Penal Code. It is alleged that the petitioners assaulted the informant, his wife and son.
It is submitted by learned counsel for the petitioners that the petitioners are agnate of the informant and due to land dispute, the accusation has been levelled and there is counter version of the occurrence also. Some of the injuries have been found to be simple though, opinion with regard to some of the injuries has been kept reserved and petitioners' side also received injuries.
Patna High Court Cr.Misc. No.32843 of 2015 (2) dt.13-08-2015 2/2 Learned counsel for the informant submits that the injuries of the informant and his son subsequently have been treated to be grievous.
In view of this Court, it is a case for consideration of regular bail.
Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Islampur P.S. Case No. 152 of 2015 pending in the court of learned ACJM, Hilsa, Nalanda. Accordingly, the application is disposed of.
