====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 26-06-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 16.03.2019 in a case for the offence registered under Sections 420, 414 and 120(B) of the IPC.

The prosecution story, in brief, is that the petitioner alongwith his associates after hatching conspiracy played fraud upon the informant after taking him in his confidence for his wrongful gain and sold a fake gold Idol to him in place of original gold Idol and when he raised protest, this petitioner alongwit his associates snatched cash Rs. 4,75,000/- from him on the point of deadly weapons and when he went to the petitioner's house and demanded his money, he started abusing

Patna High Court CR. MISC. No.38342 of 2019(2) dt.26-06-2019 2/2 him. On information, the police came and arrested the petitioner and the informant produced the fake gold Idol before the police which was sold to him by this petitioner.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. Neither date of occurrence is mentioned in the F.I.R. nor any time is mentioned in the F.I.R. The petitioner has falsely been implicated in the present case due to village politics. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Araria, in connection with Jokihat (Mahalgaon) P.S. Case No. 101 of 2019.
