JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-10-2018 The petitioner is in custody since 19.03.2018 in connection with Sikti P.S. Case No. 34 of 2010, registered for offences punishable under Section 366(A) of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the minor daughter of the informant.

Submission of learned counsel for the petitioner is that the girl has been recovered and moreover the trial has also commenced and three witnesses including the informant and the Mama (uncle) have been examined and they have stated that they have not seen the petitioner taking away the girl and petitioner is in custody since 19.03.2018.

Heard learned A.P.P. also, who opposed the prayer for

Patna High Court Cr.Misc. No.44508 of 2018 (5) dt.01-10-2018 2/2 bail of the petitioner stating that in her statement recorded under Section 164 Cr.P.C. the girl has named the petitioner and also supported the prosecution case.

Having heard both sides and in view of the facts and circumstances as stated above, I am not inclined to enlarge the petitioner on bail.

However, as the trial has commenced, learned Trial Court is directed to expedite the trial and try to conclude the same as early as possible.
