ANJANA MISHRA ORAL ORDER 18-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 18.02.2018 in connection with Phulwari P.S. Case No. 29/2018 registered for the offences punishable under Sections 302/120(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is no specific allegation against the present petitioner, save and except, it has been stated that he was also present at the place of occurrence. It was also submitted that the main allegation is against one Ajay @ Ajay Shastri and Deepak Mahto @ Steelwa and no overt act has been attributed to the present petitioner. It is further submitted that the present petitioner had also not made any

He further submits that other similarly situated person, namely, Randhir Kumar @ Randhir Paswan has been granted regular bail in Cr. Misc. No. 36635/2018 vide order dated 16.07.2018. In view of the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge-XV, Patna, in connection with Phulwari P.S. Case No. 29/2018.
