JUSTICE SANJAY PRIYA ORAL ORDER 3/ 12-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Rajpur P.S. Case No.151 of 2016 instituted for the offence under Section(s) 302, 201/34 Indian Penal Code.

It has been submitted on behalf of the petitioner that there is no allegation of any specific overt act against this petitioner. Son of the informant had gone to meet his wife (petitioner) and it is alleged that in the morning, his dead body was found hanging from mango tree.

The Sessions Judge has mentioned in the impugned order that in the Post Mortem Report cause of death has been said to be asphyxia due to hanging.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM, Buxar, in connection with Rajpur P.S. Case No.151 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) JA/- U T
