JUSTICE ARUN KUMAR ORAL ORDER 06-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 15.5.2018 seeks bail in Khajekalan PS Case No. 130 of 2018 registered under Sections 302/34 of the IPC and Section 27 of the Arms Act. The accusation is that one Javed called the informant's younger brother and while he reached near the Mazar then Arif shot in his head causing his death and it is alleged that this petitioner was also present there.

Learned Counsel for the petitioner submits that there is no accusation against the petitioner of killing the deceased, the accusation is specific against Arif and allegation against the petitioner is his involvement as one of the conspirators, except that there is nothing against him and he has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Salim is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Patna City in connection with Khajakalan PS Case No. 130 of 2018.
