JUSTICE VIKASH JAIN ORAL ORDER 16-04-2015 The present application has been filed for quashing the order dated 25.07.2012 passed in Sessions Trial No.962 of 2010 by which the learned Adhoc Additional District & Sessions Judge -V, Begusarai has rejected the petition for discharge of the petitioner.
2. None appears on behalf of the petitioner when the case is called out.
3. A perusal of the impugned order discloses that the learned court below has taken into consideration the materials in the case diary as well as the fact that some of the accused persons have been convicted earlier. It has been recorded that there are sufficient materials to proceed against the petitioner.
4. It is well settled that for framing charge against
Patna High Court Cr.Misc. No.46416 of 2012 (2) dt.16-04-2015 2/2 the accused even strong suspicion is sufficient.
5. In that view of the matter, this Court does not find any illegality in the impugned order. This petition, accordingly, stands dismissed.
