The petitioner, who is in custody due to default, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that in a case , which was registered in the year 2002 vide Siwan ( Mufasil ) P.S. Case No.216/2002, the petitioner was initially granted bail on 20.09.2003 and thereafter he was making pairvi regularly in the case. However, subsequently, he failed to keep track over the case and at much belated stage, he noticed that his bail bond was cancelled. Thereafter, he is again in custody since 07.08.2016.

Keeping in view the fact that the petitioner is now

Patna High Court Cr.Misc. No.40999 of 2016 (3) dt.06-10-2016 2/2 in custody due to misuse of privilege of bail and the fact that he was granted bail in the year 2003 and he was continuously appeared in the case, there is no reason to further detain the petitioner. Accordingly, let the petitioner, namely, Awadh Kishore Choudhary , be enlarged on bail on furnishing bail bond of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.Pandey, J.M.Siwan in connection with Tr.No.1031/2016 arising out of Siwan Mufasil P.S. Case No.216/2002.
