The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471 of the Indian Penal Code and 10 of Bihar School Examination Act.
It is alleged that in the Matriculation Examination of Bihar School Examination Board one Dinesh Kumar was found appearing in place of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner was not aware about co-accused appearing in his place and even assuming the accusation at best offence under Section 419 IPC is made out which is bailable. It
Patna High Court Cr.Misc. No.33139 of 2015 (2) dt.11-08-2015 2/2 is further submitted that non-grant of bail will jeopardize the career of the petitioner.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura P.S. Case No. 78 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
