JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-09-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The Petitioners seeks regular bail in connection with Ram Krishna Nagar P.S .Case No. 189 of 2018, registered for offences punishable under Sections 304 (B) and 120(B)/34 of the IPC Allegation against the petitioners, who happens to be in-laws of the deceased (daughter of the informant), is of assaulting and committing murder for non fulfillment of demand of dowry.

No.44552 of 2018 (6) dt.04-09-2018 2/3 Submission of the learned counsel for the petitioners is that there is general and omnibus allegation against the petitioners and the petitioners have been falsely implicated only with a view to extort the money. It is further submitted that she died due to hang and injuries were found on the throat and just below both the ears and they have been in custody since 04.06.2018.

Heard learned A.P.P. as well as learned counsel for the informant oppose the prayer for bail on the ground that the petitioners were arrested on the spot.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, XIII, Patna in connection with Ram Krishna Nagar P.S.Case No. 189 of 2018, subject to the following conditions:- i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

iii) It is made clear that if petitioners found involved in any of the like offences, in future, prosecution is free to move for cancellation of his bail bonds.
