====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 24-08-2018 Heard learned counsel for petitioner, learned for the informant and learned counsel for the State.

Petitioner, who is in custody, seeks bail in connection with Sadar (Hajipur) P.S. Case No. 543 of 2015 registered for the offences punishable under Sections 341, 420, 302 and 120B/34 of the Indian Penal Code and under Section 27 of the Arms Act.

Informant is the wife of the deceased, who has stated in his written complaint that on 10.11.2015 at about 9:00 A.M. petitioner along with co-accused persons came to his house and asked her husband to come on the disputed land. On suspicion she along with her mother-in-law went to see him and she saw that petitioner and one Harendra Singh caught hold her

No.44416 of 2018(3) dt.24-08-2018 2/2 husband and both ordered co-accused Arbind Singh to kill her husband and thereafter Arbind Singh fired on her husband causing injury on his chest and one co-accused Rohit Kumar @ Baljit also fired on her husband as a result of which her husband died on the spot.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. He has got no criminal antecedent. He is in custody since 03.04.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IV, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 543 of 2015.
