2. The petitioner has prayed for bail in connection with Marhowrah P.S. Case No. 68 of 2024 registered for the offence punishable under Section 304(B)/34 of the Indian Penal Code.
3. The case of the prosecution is that Manisha Devi was married to this petitioner three years ago. It is further alleged that demand of Rs. 2 lakh and Apache motorcycle was made by the in-laws on 29.01.2024. The informant got an information that Manisha Devi (deceased) has been killed by her in-laws. When the informant reached the matrimonial house of the deceased, he found the dead body of Manisha Devi.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.39257 of 2025(3) dt.03-09-2025 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that during the course of investigation, in Para-138, one witness namely, Deepak Kumar Yadav has stated that while he has gone to irrigate his fields, he came to know that Manisha Devi has committed suicide. When she came to the house of Manisha Devi, the informant found that the room of Manisha Devi was locked from inside. This witness has also stated that the dead body of Manisha Devi was cremated in presence of her parents and family members. It has also been submitted that from perusal of the post-mortem report, it will also transpire that the medical board has not found any external injury on her body.
Cause of death is uncertain and viscera was preserved for ascertaining the cause of death. It has also come during the investigation that the petitioner was in Delhi at the time of the said occurrence. It has lastly been submitted that a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 30.04.2025.
5. The application for bail is opposed by learned APP for the State and submits that the deceased was compelled to suicide by the petitioner.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Madhaura P.S. Case No. 68 of 2024.
